Hi Friends,

I have a website to be designed and have most of the material ready with me. I have shortlisted a designer who is ready to start. The question I have is, should I hand over the original .psd graphics files of logo etc to the designer. Is it ok to hand over the .psds or is there any risk in doing so that I should be aware of and cover with an agreement...

If you can not avoid the handover, means if you need to use these PSDs, just get the risk covered by an agreement of explicit use and copyright as wel as non-disclosure.

thank you for the advise. I will get an NDA in place. It may be a silly question but can I avoid the handover? Can i send just the jpegs? Will a website designer be able to work of .jpegs

The usage of PSD or the jpeg depend upon what kind of design the designer wish to make. If you feel that the PSDs are finalised and can not be changed, a goo JPEG out of it can do the work. Or similarly, you can think of converting it to other file types like PNG or gif. That you shall have to understand depending upon the usage and you can of course discuss the same with another web designer.

I'd make sure there's an agreement in place before you hand anything over. Remember that you can't actually prevent them from doing anything, but you can lay out what happens if they do.

Your images are protected by copyright, but your agreement should spell out the rest of what's expected. In addition to the standard "What's delivered/how and when you pay", you can lay out the following:

  • Whether you get the source they develop (as opposed to just a publishable copy of the site)
  • Whether they can take what they've developed for you and use it for somebody else (replace your logo and then sell some other customer the site
  • What happens with any other custom components
  • If they're allowed to talk to others about your work (NDA)

Before you hand anything over, at least have a basic agreement in place - if you haven't paid and you cut ties, you can at least require them to destroy what they've received from you, rather than fight with them over what happens when the relationship ends.

@mb08: As long as the resolution on the JPG is either what's needed in the final product, or is high-resolution enough that it can be cropped/resizes without artifacts, you should be okay. IF they need to tweak coloring or make any changes to the design at all, that's going to be tough without the originals. If you're protected by a signed contract, what's the concern about handing over the originals? Maybe you have a legitimate reason, but whatever you're concerned about can be laid out in your agreement, as well as repercussions if the agreement isn't honored.
