Problem with custom action in ribbon and no toolbar type

Question

Hi everybody, I have added a custom action to the ribbon on my SPF server. Location : Ribbon.ListItem.Action.Controls._children

Everything work fine until i decide to setup an xlstviewwebpart in my home page and change the toolbar type of the current view to no toolbar.

At this time the custom action disapear, if i modify the toolbar type to full toolbar the custom action is here.

Any way to fix this ?
